Out of experience, it seems like your unit converts a herdable after a random time, ranging from basically instant to more than a second or so. As sioux you sometimes even run your explorer past a herdable and it won't convert at all, because you're gone too fast.
So if your explo finds the herdable earlier, but you're unlucky with rng, your opponent will still convert it before you.
Another thing to add to the long list of dumb rng mechanics that imo deserve to be removed

I'm pretty sure there is a simple reason why it works like that; performance. It was just considered too costly to run the unit-within-range check more often than this. You can experience a similar behavior with auras, as they too aren't updated in "real-time", but periodically.

Similarly, if you play a recorded game fast, the LOS of units in minimal doesn't update instantly.
Attack moving when you're not in range yet is actually better because you'll overkill a lot less
